Welcome to BOOMSHACKAGALAXY ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
The Developer grants you a personal, non-transferable, non-exclusive, revocable license to download and use the App on devices you own or control, solely for your personal, non-commercial entertainment, in accordance with these Terms and any rules imposed by the Apple App Store or Google Play Store.

The App is completely free and contains no in-app purchases and no advertising. In-game Credits are earned solely by playing and are used to unlock cosmetic ships. Credits have no real-world value, are non-transferable, and cannot be purchased or exchanged for cash.
When playing online co-op battle, you agree to behave respectfully toward other players. The Developer reserves the right to terminate access to multiplayer features for users who abuse the system, although the App does not currently collect personal information that would identify individual players.
All content in the App — including but not limited to artwork, music, sound effects, code, design, and the "BOOMSHACKAGALAXY" name and branding — is the property of the Developer and is protected by copyright and other intellectual property laws.
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. The Developer does not warrant that the App will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Because the App is free and contains no purchases, the Developer's total liability for any claim shall not exceed ten U.S. dollars ($10).
The Developer may terminate or suspend your access to the App at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the App ceases immediately.
The Developer may modify these Terms at any time. Updated Terms will be posted at this URL with a revised "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the United States and the state in which the Developer resides, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction.
You acknowledge that these Terms are between you and the Developer, not Apple. Apple has no obligation to provide maintenance or support for the App. In the event of a third-party claim that the App infringes intellectual property rights, the Developer (not Apple) is responsible. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
